There are a variety of medical conditions that can prompt the California Department of Motor Vehicles to suspend
a driver’s license. However, the DMV can’t take the
driver’s license without a medical suspension hearing. A driver facing a California medical suspension
hearing is entitled to be represented by a lawyer and introduce
evidence supporting his or her fitness to drive. The
caring attorneys of The Kavinoky Law Firm are experienced in
every aspect of DMV medical suspension hearings, and will make every
effort to help a driver with a medical suspension remain behind
the wheel.
At the medical suspension hearing,
the Department of Motor Vehicles hearing officer will review information
about the driver’s medical condition as well as any relevant
tickets or accidents. The driver can offer evidence in support of
remaining licensed, such as letters from doctors or enrollment in
a driver safety course.
Once the DMV hearing officer has reviewed all of the evidence, he or she will make a decision about the status of the driver’s license. If the hearing officer determines that the motorist’s condition prevents safe driving, the license will be medically suspended.
Unfortunately, a medical suspension of a California driver’s license is indefinite, meaning the license will remain suspended unless the driver’s condition changes to the extent that the Department of Motor Vehicles determines the individual can safely operate a motor vehicle.
Fortunately, if the driver’s condition changes significantly, the license can be reinstated. To regain a valid license, the driver must request a second medical suspension hearing and have his or her physician complete the DMV’s Driver Medical Evaluation form. If the DMV hearing officer is persuaded of the driver’s competency, the motorist will be given the opportunity to take a written test and a Driver Performance Evaluation. If the driver passes both of those tests, the license will be reinstated.
Unfortunately, many California driver’s license medical suspensions stem from the consequences of aging. While the California Department of Motor Vehicles cannot suspend a driver’s license based on age alone, many older drivers suffer from the loss of reflexes, eyesight, and other physical abilities as they age. However, that doesn’t mean that driving privileges are lost forever. Senior motorists can enroll in driver safety courses, have their vision corrected, and take other steps that will greatly improve their chances of remaining behind the wheel.
A California DMV medical suspension is indefinite, but that’s
actually good news for the driver, because the license can be reinstated
at any time if the condition that triggered the suspension improves. The compassionate attorneys of The Kavinoky
Law Firm are ready to help any driver with a medical suspension
regain a license, rights and freedom. Contact them today for a free
